Justice Ashi however granted the accused person bail in the sum of N50m with two sureties in like sum.

The sureties, who must be resident within the jurisdiction of the court, must produce certified evidence of ownership of landed property and must always produce the accused person in court in subsequent proceedings, failing which they would be liable to pay the sum of N250m each.

Black Christmas: Federal Operation Unit Owerri Impounds N12m Frozen Poultry

… As Oyo  Customs Command Intercepts 11 Vehicle- Loads Of Of Hemp
Officers of Federal Operations Unit (FOU), Zone ‘C’ Owerri yesterday intercepted a Mercedes truck loaded with 1,300 cartons of imported frozen poultry products, with a Duty Paid Value (DPV) of N12,400,000 on Benin-Ore Expressway, effectively denying expectant Nigerians the sumptuous ‘contraband’.

Concealed with Polymers Vinyl Chloride (PVC) sheets and ceramic bath tubs only two days before the Christmas day, the FOU, an anti smuggling arm of the Nigeria Customs Service (NCS) snatched the item, just as another crack team of Customs Officers of the Osun- Oyo Command, Sunday night, at about 11.45pm,  20th December, 2015; intercepted and arrested 11 fairly used vehicles, fully loaded with bags of Canabis Sativa (Indian Hemp), foreign rice and other general goods along Eruwa axis in Oyo State.

Speaking in respect of seizure- development on the Owerri axis, the FOU Boss, Comptroller David Dinka who had earlier promised a bleak Christmas for illicit traders in the area, revealed a total 31 seizures which included 21 vehicles between 1st December to date with DPV of N118,190,217, with 23 arrests made ,out of which 22 cases are now pending in different courts within the Zone ‘C’ axis.
Dimka who decried the incalculable harm being inflicted on the nation’s economy as a result of unabated smuggling of prohibited products into the country, warned those still engrossed in the act to desist forthwith or  have themselves to blame if arrested.
“We will continue to make this Zone very very hot and uncomfortable for smugglers to remain in business and we are not mincing words about this”, he highlighted, noting that, the one suspect arrested in connection with the smuggling of the imported frozen poultry product was presently undergoing interrogation for further prosecution in court.
He stressed that the NCS was trying to ensure that it does not give any chance to smugglers until they are brought to their knees, warning “a word is enough for the wise.”
The destruction of the seized imported frozen poultry products was later carried out in the premises of Customs House Benin, and was witnessed by the Nigeria Police, Nigeria Security and Civil Defense Corp, Department of State Security, NAFDAC, and the press.
Dimka expressed delight at the desirable and cordial synergy between the NCS and other sister agencies such as the Nigeria Police, State Security Service (SSS), Nigerian Army, National Drugs Law and Enforcement Agency (NDLEA) and the Federal Road Safety Commission (FRSC) in the fight against smuggling and expressed optimism that this would continue to grow from strength to strength.
The Area Controller affirmed that the determination of Nigeria Customs Service to reposition itself for greater challenges remained unstoppable, as he recalled the Comptroller General of Customs, Col. Hameed Ibrahim Ali (Rtd.), repeated warnings that smugglers operating in the country must be brought to their knees.
Dimka left no one in doubt that all suspects arrested in connection with smuggling activities who were on bail, were still not free until the determination of their cases in court; as those found to have contravened the law would be jailed.
Meanwhile, the Osun-Oyo Customs Command has denied regular supply of hemp to hardened smokers as the command snatched 11 vehicle-load of Canabis Sativa, along the Eruwa axis, Sunday night.
Ironically, this came on the heels of five trucks load of 3000 bags of smuggled imported rice, whose importers had attempted to evade duty payment.
“This is keeping to our stand that there is no going back with duty payment on rice imports from the land borders and there is no hiding place for smugglers within the Oyo/Osun Command area especially during this Christmas season”, declared the Acting Area Command boss, Comptroller H. Abdulsalam.
He indicatedthat while the Indian hemp is to be handed over to the Oyo State NDLEA Commander, Mrs. Omolade Faboyede for further investigations after this press briefing to enable further investigation, while building on the robust relationship between the two other organizations, he would pursue the case of rice smuggling and other duty evaders, to its logical conclusion.
“I use this medium to assure all genuine and patriotic importers of our support via trade facilitation while the recalcitrant ones will either repent or face the wrath of the law”, Abdulsalam concluded.

He pleaded not guilty to the charge when it was read to him.
Justice Amadi, adjourned the matter January 21, 2016 for commencement of trial.

EFCC Advocates Time Frame for Corruption Cases

Ibrahim Magu, Acting Chairman, Economic and Financial Crimes Commission, EFCC, on Thursday, December 17, 2015 called on the National Assembly to enact a law to fix a time frame for the determination of corruption cases.
He said such a law would fast-track corruption cases in court.
The EFCC boss made the plea while receiving members of the Senate Committee on Anti-Corruption and Financial Crimes led by its Chairman, Senator Chukwuka Utazi, who were in the Commission on an oversight visit.
The anti graft czar sought the support of the Senate Committee to make the anti graft war successful saying, “we need the support of this Committee to achieve the mandate given to us to help rescue our country from the shackles of corruption”.
He also identified inadequate office accommodation as a major challenge facing the Commission since its creation 12years ago, and called on the Committee to use its good offices to fast-track the completion of the Commission’s Head Office project.
“We have accommodation constraint; we operate from rented apartment scattered around Abuja… I wish to call on the Committee to use its good offices to fast-track the completion of the Commission’s Head Office project”, Magu pleaded.
Earlier, Senator Utazi pledged to support the Commission through legislation to further strengthen its operation.
He said the visit was part of the legislative agenda of the 8th Senate geared towards collaborating with the executive arm of government to reduce corruption and move the country forward.
Senator Utazi noted that, the EFCC is an important office in the fight against corruption as it represents the executive arm of government in the anti corruption war.
He said the visit was to interface with the management of the Commission and identify areas of need, to ensure smooth running of the EFCC.
“The visit is not to witch-hunt anybody, but to establish a synergy that would enhance the activities of the Commission in the fight against corruption”, Utazi said.
Thereafter, the EFCC boss, accompanied by his management team led the Committee members on a visit to the permanent site of the Commission’s Head Office under construction, where his guests expressed delight over the quality and level of work so far done.
Other members of the Committee during the visit include Senators Musa Ahmad, Matthew Urhoghide, Sani Mustapha Mohammed and Sani Abdullahi.

NDLEA RECOVERS HARD DRUGS IN SABONGERI MARKET KANO

The National Drug Law Enforcement Agency (NDLEA) Kano State command has discovered large consignment of Tramadol Hydrochloride at the popular Sabongeri market, Kano. Justice F. O. Riman of the Federal High Court Kano sentenced a patent medicine dealer, Gerald Ohuruzo, 42, for dealing in Tramadol Hydrochloride. Tramadol is a prescription drug and pain reliever used to treat moderate to severe pain but gradually becoming one of the most abused drugs in the north.
The Agency also arrested 94 suspected drug traffickers including a patent medicine dealer who allegedly stockpiled Tramadol in a secret warehouse within the market. The convict, Gerald Ohuruzo, 42, was arrested when his secret warehouse at the Sabongeri market was discovered by anti-narcotic officers working on intelligence report. The recovered drugs in his warehouse weighed one thousand, three hundred and sixty-nine kilograms (1,369kgs). He pleaded guilty to dealing in psychotropic substances and was sentenced to 4 years imprisonment on Monday December 14, 2015. Justice Riman however gave Gerald an option of four hundred and fifty thousand naira (N450,000) fine.
Sequel to the discovery, the Kano State command has commenced a holistic operation to drastically reduce cases of drug abuse. According to the State commander, Mr. Hamza Umar, “NDLEA has started a total cleanup operation geared towards reducing cases of drug abuse to the barest minimum. The command raided Sabongeri market where we seized 1,369kgs of tramadol from one Gerald Ohuruzo who was convicted this week. The command had earlier detected a warehouse where tramadol hydrochloride weighing six thousand, two hundred and sixty-four kilograms (6,264kgs) was seized. Our investigators are working towards a safe and drug-free society”.
Hamza disclosed that the command arrested ninety-four (94) suspected drug traffickers in November 2015 with a total of 6,518.399kg. These include 247.715kg of cannabis, 6,270.677kg of psychotropic substances and 6.6grammes of cocaine.
The suspect who hails from Imo State attributed his involvement in prohibited substances to the high demand for the drug in Kano. “I am a patent medicine dealer and I am married with four children. This is a mistake on my part. Though I began to deal in tramadol due to the high demand for the drug, I should have resisted the temptation to sell such drugs. I have never been arrested and I feel very bad” Gerald stated.
Worried by the large seizures of narcotic drugs in the ancient city of Kano, the Acting Chairman/Chief Executive of the National Drug Law Enforcement Agency (NDLEA), Mrs. Roli Bode-George said that the Agency will conduct series of enlightenment campaign programmes in the North West State of Kano in the New Year. “The large seizures of tramadol hydrochloride is very disturbing. We are going to address the situation scientifically by combining drug seizures with drug demand reduction activities in the coming year. We hope to provide anti-drug abuse counseling services and rehabilitation for those with drug abuse problem” Roli stated.
The NDLEA boss also promised to partner with the Kano State government, Non-Governmental Organizations (NGOs) and relevant support groups in providing help to members of the public with regards to narcotics. In her words, “drug control is not the exclusive preserve of NDLEA. It is a collective responsibility where we must complement one another. Our doors are therefore open to stakeholders at all levels as we welcome fresh ideas in tackling the problem of drug cultivation, trafficking and abuse”.
Roli tasked the commander to work very hard to identify and apprehend the owner of the second warehouse where over 6 metric tons of illicit drugs was recovered.

N13.5bn Arms Scam: Dasuki, Others Granted Bail

EFCC Press Release

Justice Hussein Baba-Yusuf of the  Federal Capital Territory( FCT) High Court, sitting in Maitama, Abuja, on Friday, December 18, 2015, granted Col. Sambo Dasuki( rtd.), a former National Security Adviser, and five others bail in the sum of N250m each.

Dasuki alongside Shuaibu Salisu, a former Director of Finance and Administration, Office of the National Security Adviser; Aminu Babakusa, a former General Manager, Nigerian National Petroleum Corporation; Acacia Holdings Limited and Reliance Referral Hospital Limited are being prosecuted by the Economic and Financial Crimes Commission, EFCC,  on a 19-count charge  bordering on money laundering and criminal breach of trust to the tune of N13, 570,000, 000.00(  Thirteen Billion, Five Hundred and Seventy Million Naira).

One of the counts reads: “That you, Col. Mohammed Dasuki( rtd.), whist being the National Security Adviser and Shuaibu Salisu, whilst being the Director of Finance and Administration in the Office of the National Security Adviser, and Hon. Warripamowei Dudafa(now at large), whilst being Senior Special Assistant, Domestic Affairs to the President, on or about 27th November, 2014 in Abuja within the jurisdiction of this Honourable Court entrusted with Dominion over certain properties, to wit: the sum of N10, 000,000,000( Ten Billion Naira) being part of the funds in the account of the National Security Adviser with the Central Bank of Nigeria( CBN),  the equivalent of which sum you received from the Central Bank of Nigeria in foreign currency to wit: $47,000,000( Forty-Seven Million dollars)  and 5.6 million Euros, committed criminal breach of trust in respect of the said property when you claimed to have distributed same to the Peoples Democratic Party(PDP) presidential primary election delegates and you thereby committed an offence punishable under section 315 of the Penal Code Act, Cap 532, Vol.4 LFN 2004.’’

At the last sitting, counsels to the five defendants had urged the court to grant their clients bail, arguing  that the charges preferred against them were bailable.

However, the prosecution counsel, Rotimi Jacobs,SAN, had prayed the court to refuse the five defendants bail based on the gravity of the alleged offences committed as well as the proof of evidence against them.

According to him ‘‘they are not entitled to bail because they may jump bail. I recognise that the granting or refusal of bail is at the discretion of the court. But if they will interfere with investigation of other cases that will be instituted against them, you can refuse them bail. If bail application is filed, it is not automatic that it must be granted. The proof of evidence showed the purposes for which the money was meant for, which was for the purchase of security equipment.’’
In his ruling on the bail application at today’s sitting, Justice Baba-Yusuf granted each of the accused persons bail in the sum of N250m with one surety in like sum, who must deposit their international passports with the court.

The surety must be a top civil servant not below the level of Director; with evidence of ownership of a property worth N250m.

Justice Baba-Yusuf also ordered that counsels to the defendants must notify the court about the travel arrangements of their clients, whenever they are leaving the jurisdiction of the court.

He, however, ordered the accused persons to be remanded in the EFCC custody pending fulfillment of their bail conditions.

The case has been adjourned to January 21 and 22, 2016 for commencement of trial.

$8.4m Scam: Lagos Court Registrar Bags Ten Years

Justice Lateef Lawal Akapo of a Lagos State High Court sitting in Ikeja, on Monday convicted and sentenced a former court registrar, Mrs Rosulu Idowu Oluronke, to 10 years Imprisonment.
Oluronke, a former registrar to Justice Joseph Oyewole, was prosecuted on a two- count charge of conspiracy and obtaining money under false pretence, preferred against her by the Economic and Financial Crimes Commission, EFCC. She was initially charged alongside a Lagos socialite, Fred  Ajudua before Justice Oluwatoyin Ipaye for defrauding a former Chief of Army Staff, General Ishaya Bamaiyi ( retd), the  sum of $8.4Million ( Eight Million, Four Hundred Thousand United States Dollars), while he was being detained in Kirikiri Maximum Prison over his trial for the attempted murder of the late publisher of Guardian Newspapers, Chief Alex Ibru.
Specifically  Oluronke  aided Ajudua to defraud Bamaiyi of the said sum under the false pretence that it was a part payment for the professional fees purportedly charged by Chief Afe Babalola (SAN) to handle his case, while both of them were being remanded at Kirikiri Maximum Prison between November 2004 and June 2005.
However,  Oluronke opted for a separate trial and was arraigned before Justice Lawal Akapo on April 20, 2015.  Delivering his judgment today, Justice Lawal Akakpo held that some incriminating documents linking her with Ajudua were found in Oluronke's house,  when a house search was conducted there and that there was no doubt that there was conspiracy between her and Ajudua in the matter. “I hold that the accused visited Kirikiri prison on three occasions; with this, there is no doubt on the intention to defraud", he said.

It will be recalled that the EFCC had insisted that Oluronke was an accomplice in the case and called six witnesses. One of the witnesses was General Bamaiyi (retd), who told the court that Oluronke actually came to see him several times in prison.
But the turning point in the trial was when the Commission presented evidence of polygraph test administered on the convict by polygraph experts from the Commission’s Internal Affairs Department. It was the first time polygraph evidence would be admitted in criminal trial in Nigeria.

Controversy Trails Rate Of HIV/AIDS In Nigeria

By Peterclaver Egbochue

Although, there seems to be an increased awareness on the adverse implication of a HIV/AIDS ravaged society and the need for people to adopt healthy lifestyle, yet the spread of the scourge in Nigeria has not reduced drastically.

Experts argue that this was the result of Nigeria’s poor health care delivery system. While the disease is already witnessing a reduction in some other countries, Nigeria’s health authorities have not demonstrated enough commitment in arresting the spread of the disease.
Experts who met at the American Conference on the Treatment of HIV, which held in Denver, Colorado in the United States, not too long ago, further strengthened this position.
Their assessment was that infection rate had been on the rise just because the country was no longer taking reasonable precautions to protect the vulnerable members of the society against the spread of the disease and the inevitable consequence, which is a high mortality rate.
According to Margaret Lampe of the US Centres for Disease Control and Prevention, the number of people living with HIV/AIDS in Nigeria increased by almost 500,000 in three years, while the number of AIDS-related deaths also witnessed a marginal rise to 217,148 within the same period.
Dr. Jean Anderson of the Johns Hopkins Medical Institute, Maryland, noted that there has been an increase in the rate of infection through blood transfusion and mother-to-child transmission, despite the fact that such forms of transmission are easily preventable.
The National Bureau of Statistics (NBS) in a recent report averred that most deaths in the country were disease-related. From the diseases identified in the report, HIV/AIDS accounted for much of the deaths.
Since its discovery in the early 1980s, HIV/AIDS, has been a critical health issue for women and men as the epidemic continues to undermine development efforts worldwide and mostly afflict populations already beset by extreme poverty and lack of awareness.
HIV/AIDS has been particularly noted to affect the working population and preventing women and men from making meaningful contributions to development and improvement of families while at the household level, the epidemic increases the burden of care and erodes savings.
The National Bureau of Statistics (NBS), in its recent report entitled ‘Statistical Report on Women and Men in Nigeria’, identified malaria, pneumonia, tuberculosis, diarrhoea, hepatitis B, measles and some others as among the killer diseases in the country.
“The proportions of those infected with pneumonia, tuberculosis, diarrhoea, yellow fever and measles were equally significant accounting for over 45 percent cases in both sexes in the reference period,” the report stated.
From the report, the editorial emanating from it concluded that “the prevailing strategy” to win the war against the HIV/AIDS pandemic had not worked.
The MDG goal number 6 calls for the halting and beginning of the reversal of the spread of HIV/AIDS before the end of 2015. About 59 percent of adults living with HIV are women.
However, the National Agency for the Control of AIDS (NACA) has since dismissed the claim as baseless, insisting that Nigeria was winning the war against HIV/AIDS.

The director-general of NACA, Prof. John Idoko, however, said the report only gave unfounded percentages of AIDS deaths without stating the total number of deaths upon which the percentages were based.
“The total number of deaths and the number of deaths due to AIDS which resulted in the percentages were not given. Even the “Summary Distribution of Deaths by Causes, Year and Sex (2010-2014)” – Table 2.2a at page 7 of the report did not capture HIV/AIDS among the diseases.”
The NACA DG insisted that if the factual AIDS deaths given were taken into cognizance, malaria which accounted for 108,453 deaths in 2012 and 46,612 deaths in 2014, according to the ‘Summary distribution of deaths by causes, year and sex’, by far accounted for more deaths than AIDS in Nigeria within the period.
Idoko, said HIV prevalence had declined from 5.8 percent in 2001 to 4.1 percent in 2010 and that new HIV infections declined by about 50 percent from 338,423 in 2005 to 176,701 in 2015. He maintained that HIV/AIDS had been in decline in Nigeria in the past five years, due to improved funding by the Federal Government and the sustained efforts of international partners.
According to him, this has made it possible for the number of people living with HIV who are on Anti Retroviral Therapy to sharply increase from 359,181 in 2010 to 747,382 in 2014.
“There are more remarkable improvements attributable to Nigeria’s HIV response. For instance, the number of HIV counseling and testing sites across the country from 1,046 in 2010 to 8,114 in 2014. The number of people tested for HIV has significantly increased from 1,380,418 in 2010 to 7,101,636 in 2014,” he further stated.
On Prevention of Mother to Child Transmission (PMTCT), Idoko said the number of sites had increased from 675 in 2010 to 6283 in 2014 while the number of HIV positive pregnant women who received anti-retroviral prophylaxis to pregnant mother to child transmission has increased by over 87 percent from 33,891 in 2010 to 63,350 in 2014.
He said, “From these figures, it is clear that Nigeria has made significant progress in AIDS response. Effective antiretroviral treatment provides a dual effect of saving the lives of people living with HIV and sharply interrupting the transmission of HIV within the community.
“With improved domestic budgeting for HIV/AIDS and sustained external funding, there are plans to expand the coverage of antiretroviral treatment to 1.2 million adults and children by 2017 through the establishment of 2000 additional treatment sites.
“This and other prevention and control activities are important steps towards achieving an end to AIDS epidemic by the year 2030. “
Only recently, the country director, Joint United Nations Programme on HIV/AIDS, Bilali Camara, has said that Nigeria requires $1.2bn (N236.4 trillion) for the treatment of HIV/AIDS in the country.
Camara who said this at a workshop on the 90-90-90 treatment target put together by UNAIDS in collaboration with NACA, observed that foreign donors provide $600,000 (N118.2 million), which represents 50 per cent of the funds required for the treatment programme, while Nigeria provides 25 per cent of the funds required.
According to Mr. Camara, the fund provided by Nigerian government was grossly inadequate to close the treatment gap in the country, adding that Nigeria needs more domestic funding to effectively tackle HIV/AIDS epidemic in the country.
He said the state governments had not shown enough commitment in the area of resource allocation to fight the disease, adding that “There is lack of leadership at state level to address the issue in pragmatic way.”
His words, “Our intention is to ensure that journalists reporting HIV/AIDS keep on helping the public to understand and support the drive to achieve the target by 2020. The participation of representatives of people living with HIV will give us an opportunity to get new ideas that will keep Nigeria on the path of ending the AIDS epidemic by 2030.”
The country director said the target would ensure that by the year 2020, 90 per cent of all people living with HIV would know their HIV status.
“90 per cent of all people with diagnosed HIV infection will receive sustained antiretroviral therapy and 90 per cent of all people receiving antiretroviral therapy will have viral load suppression,” he said.
The National coordinator of the Network of people Living with HIV/AIDS in Nigeria, Mr. Edward Ogenyi, noted that when people living with HIV understand the 90-90-90 target and drive the process, it would send the message down to the communities.
“It will also ensure that more Nigerians will be tested for HIV and the ones who need treatment will access it,” he said. “The target motivates those who are already on treatment to adhere to it so they can suppress the virus and continue to live a healthy and productive life.”

Stress Management, Healthy Diet Reduces Hypertension Risk

By Peterclaver Egbochue

Hypertension also known as high blood pressure is a serious health issue that should not be treated with kid gloves. There are several reasons why you have hypertension in the first place. The most prominent is stress and unhealthy habits.
According to the World Health Organisation (WHO), hypertension affects more than one billion people globally, stressing that one in three adults aged 25 and above suffer from the ailment, which has been widely described as a silent killer.
Speaking at the quarterly health awareness campaign organized by the LUF Foundation in collaboration with the Lagos State Ministry of health over the weekend, Dr. Uche Amanze, a Nephrologist and the Managing Director of Crystal Hospital, Lagos, noted that hypertension is one of the most important precipitators of heart diseases and stroke – thereby making it the number one cause of premature death and disability around the world.

He maintained that high blood pressure is largely preventable through the adoption of lifestyle modifications at early stages of life and therefore have recommended the adoption of the following approaches to keep the non-communicable disease at bay.

Dr. Amanze recommended that a healthy and balanced diet is essential to keep a check on BP. Dietary Approaches to Stop Hypertension (DASH) is a good way to avert hypertension.

The DASH diet, he stated contains plenty of fresh fruits, vegetables, dairy products which are low in fat, fish, whole grains, poultry and nuts; the diet is also low in red meats, sugar-sweetened beverages, and sweets. These items make the DASH dietary pattern rich in calcium, magnesium, potassium, protein and fiber and low in cholesterol and fat.

Stress management – Research shows a direct link between stress and raised blood pressure. In modern days due to erratic lifestyle, long working hours, frequent break-up of relationships, stress is on all-time high. “There is no time for relaxation. Everybody is leading a super busy life. Thus, it is important to lessen and manage mental stress through relaxing techniques like deep breathing exercises, spending time on yourself, social networking, yoga, and meditation,” henoted.
Exercising regularly – Aerobic exercise, and possibly resistance training, have been found to lower one’s BP. If one has prehypertension (systolic pressure between 120 and 139 mm HG or diastolic pressure between 80 and 89 mm Hg), exercise can surely help him/her in averting develop hypertension.
Limiting the sodium intake – One has to cut down on sodium through the reduction of the salt added to food and eliminate trans fats from their diet. Sodium content is directly proportional to blood pressure. One should not add extra salt to their meals. One good way of keeping a check is to use saltshakers; it keeps a restraint on the amount.
Limiting alcohol consumption and smoking – These have been directly linked with a higher risk of hypertension and must be strictly avoided. If one is a heavy drinker or chain smoker, he/she should start with reducing the amount and then finally quit.
Hypertension is mostly a silent disease and it often goes unnoticed due to the vagueness of its symptoms, which include occasional headaches, confusion, buzzing in one’s ear amongst others. Thus, it is important to keep monitoring one’s BP regularly. Timely anticipation and detection of the silent disease is required to avoid any fatal consequences.
